Au Carré Saint-Eloi - Arras - Our General Sales Conditions

General terms and conditions of sale for stays in Au Carré Saint-Eloi d'Arras guest rooms and the Mamarras gîte, applicable to 15 April 2019

Article 1 - Duration of stay: the customer who signs this contract for a fixed period may not under any circumstances claim any right to remain in the property.

Article 2 – Validation of a booking: Stays are only guaranteed on receipt of a deposit, which can be deducted from the invoice on arrival. Deposits are cashed on receipt. Deposits must be paid within 5 days of the booking request.

Deposit required (50% or by quotation when booking online):
- either by cheque made payable to Claire KAPOUN, 3 place du Wetz d'Amain, 62000 Arras, to be enclosed with the booking contract.
- or by bank transfer free of charge (quicker for a guaranteed reservation / please check with your bank for the amount of any charges).
Your reservation becomes firm once a deposit has been received. Payment of a deposit implies acceptance of these general terms and conditions of sale for bed and breakfast accommodation.

For all bookings made at least 3 weeks in advance, a booking contract will be sent to you (detailing the services selected), which must be returned signed and accompanied by the deposit if applicable if you are paying by cheque.

For Mamarras accommodation at 110 rue Saint-Aubert in Arras, a deposit of €50 in cash will be collected on arrival. This will be returned on departure if no fault is found.

Article 3 – Cancellation by the customer: any cancellation must be notified by registered letter to the owner.

Cancellation before the start of the stay at Au Carré Saint-Eloi in Arras :
- if the cancellation is made more than 24 hours before the start of the holiday, the deposit will be retained by the owner.
- if the cancellation is made less than 24 hours before the start of the stay, the deposit is retained by the owner, who reserves the right to claim the balance of the price of the accommodation.

If the customer does not show up before 7 p.m. on the day scheduled for the start of the stay, this contract becomes null and void and the owner may dispose of his guest rooms. The deposit remains the property of the owner, who reserves the right to claim the balance of the price of the accommodation.
Any additional services not used will be reimbursed.
In the event of a shortened stay, the full price of the accommodation remains the property of the owner.

Article 4 – Cancellation by the owner: if the owner cancels the stay at Au Carré Saint-Eloi d'Arras before the start of the stay, he must inform the customer by registered letter with acknowledgement of receipt. Without prejudice to any claims for damages, the customer will be reimbursed immediately for any sums already paid. They will also receive compensation at least equal to the penalty they would have paid if the cancellation had been their fault on that date. The owner may offer equivalent alternative accommodation; the customer is free to accept this or not.

Article 5 - Arrival time: the customer must arrive on the day specified in the booking and at the times mentioned below.
Except in exceptional circumstances, rooms are available from 5.30pm. Please let us know if you plan to arrive after 7.00 pm; arrivals after 8.30 pm should be avoided.

Article 6 - Check-out time: Rooms must be vacated before 12 noon.

Article 7 – Payment of the balance of the accommodation : The balance of the stay must be paid on arrival at Carré Saint-Eloi d'Arras. Consumption and additional services not mentioned in this contract will be paid at the end of the stay.

Article 8 – Visitor's tax: the visitor's tax is collected by the owner on behalf of the intermunicipality, i.e. the Communauté Urbaine d'Arras. It is paid in full to the latter.

Article 9 –

a Change of rooms: Without the customer being able to claim any compensation, the operator reserves the right to change the room initially booked by the customer for a room of the same capacity. In this case, the cost of the reservation remains unchanged.
b Capacity: This contract is drawn up for a specific number of people. If the number of guests exceeds this number, the owner is entitled to refuse additional guests.

This refusal can in no way be considered as a modification or a breach of the contract at the initiative of the owner, so that in the event of the departure of a greater number of guests than those refused, no reimbursement can be considered.

Article 10 - Pets:

Au Carré Saint-Eloi accepts guide dogs. For other situations, unless expressly agreed at the time of booking, pets are not accepted. In the event of non-compliance with this clause by the customer, the refusal to accept animals and their owners by the owner of the guest rooms cannot be assimilated to a modification or breach of contract at the owner's initiative. Consequently, in the event of the customer's departure, no reimbursement can be considered.

Article 11 - Art of living, use of the premises :

All guests of Au Carré Saint-Eloi d'Arras are asked to respect a certain art of living in order to guarantee the peace and quiet of the premises, the comfort of its guests and to use them in accordance with their intended purpose.
Guests are also asked not to smoke in the house. The customer undertakes to respect the etiquette set out in these general terms and conditions of sale. The customer undertakes to return the rooms in perfect condition at the end of the stay and to declare, and assume financially, any damage for which he/she may be responsible. Children (up to the age of 18) staying in our house are the sole responsibility of their parents.
If you forget anything in your room at the end of your stay in our B&B in Arras, your belongings can be sent to the person concerned, at their request and expense.

Article 12 - These terms and conditions of sale may be amended at any time without prior notice. Acceptance of and compliance with these terms and conditions of sale are deemed to have been accepted as soon as the deposit has been paid.

Article 13 - In accordance with the Law of 6 January 1978, you have the right to access and rectify data concerning you. Au Carré Saint-Eloi in Arras undertakes not to pass on the information you have provided to other companies or organisations without your consent.
